Terms and Conditions 2012
Move with Us work with a network of approved estate agents and law firms to provide you with an excellent home move experience.
These are the terms and conditions of our arrangement with you. We will use we/us/our and you and your throughout. Your/The Conveyancer is the conveyancing lawyer appointed by us to act on your transaction.
Places and Hours of Business
Our offices are located at Grant Hall, Parsons Green, St Ives, Cambridgeshire PE27 4AA. Our normal hours of opening are between 9.00 am and 8.00 pm weekdays. Your Conveyancer may have different hours of business and will advice you of these in their terms of business.
The services
We provide supplemental services to law firms to support them in the provision of conveyancing.
The services offered include:-
- outsourced customer service
- a one stop search portal
- on-line monitoring, and reporting of cases
- electronic Identity Verification required by the European Anti Money Laundering Directive
- property fraud prevention
Cost of Service
The cost of the service is included in the Conveyancing Fee provided in our estimate. The fees will become due on exchange and will be payable on completion.
Your Conveyancer will provide you with our invoice and collect from you the monies payable to us for the service and will pay it to us on completion.
By instructing your Conveyancer, you will be irrevocably authorising them to collect our fees from you and make the payment to us on your behalf.
No Sale – No Legal Fee
Your Conveyancer offers their service on a “No Sale, No Legal Fee” basis. This means that if your transaction falls through prior to exchange of contracts you will not have to pay for the work they have completed in connection with the transaction, except as previously advised to you by them in the case of work outside of the normal conveyancing process.
You should note that you will still be responsible for any disbursements paid on your behalf but in most cases you will have already provided payment for these up front.
The written fixed legal fees, together with the detailed estimate of standard disbursements you will be required to meet, will have been provided with your quote letter. Please pay particular attention to the information provided on the last page of the letter.
Monies On Account of Disbursement (Payments to Third Parties)
We will collect from you the amount required to cover the cost of the required Land Registry Documents or Searches as required by your Conveyancer.
Please note that any funds taken will be held on account until your Conveyancer notifies us to order the searches or documents required. If there are any surplus funds after searches or documents have been ordered, these will be forwarded to your Conveyancer to be deducted from the final invoice.
If we do not hold sufficient funds to order all searches, we will contact you to obtain the balance required.
If for any reason, you decide not to proceed with your transaction, please contact Move with Us to reclaim any monies held on account for you. Any unused monies will be held on your behalf for three months from receipt. If you do not reclaim them, or use them on another transaction through us, during this time then we will charge you an administration fee equal to the amount held inclusive of VAT. If you request a refund, at any time up to 6 months from the date on which we collected monies from you, we shall refund the monies due to you within 5 working days of receipt of your request.
Joint Instructions
Where a property is jointly held or will be purchased jointly we may accept instructions from any joint owner or joint purchaser of the property and you will be bound by those instructions.
On line Case Tracking
The On Line Case Tracking service provided by us is designed to be available to you 24 hours a day, seven days a week, however, on occasion the service will not be available due to maintenance of the systems or matters outside of our control. Move with Us will not be liable for any loss in service, however, we will restore the service as soon as we are able.
The milestones on the Case Tracking service are updated by your Conveyancer and Move with Us will not be liable for any inaccurate recording of those milestones for whatever reason.
Data Protection
Under the Data Protection Act, we have to advise you that your details will be held on our database.
We may, from time to time, with your permission send you details of special offers or information which you may be interesting. We will NOT supply such information to third parties unless required to do so by Law, e.g. the new Money Laundering Provisions.
Termination
You may terminate your instructions to us in writing at any time, however, you will remain liable for the cost of our service in respect of any instruction passed by us to your Conveyancer, or related transaction, which will become due on exchange of contracts and payable on completion.

Your instructions to Us
By instructing your Conveyancer to undertake the conveyancing transaction or any related transaction for you, you are accepting these terms and conditions and authorising your Conveyancer to pay our fees on completion of your transaction.
